These Terms & Conditions govern the use of the TRX MOTO INC. (“TRX MOTO”, “we”, “us” or “our”) website and purchases made through it.
By using our website or placing an order, you agree to these Terms & Conditions, subject to any rights and protections that cannot be excluded or limited under applicable law.
1. GENERAL
TRX MOTO operates an online and physical motorcycle parts, accessories, riding gear and service business in Quebec, Canada.
We reserve the right to update our website, product selection, services and these Terms & Conditions from time to time.
2. PRODUCT INFORMATION
We make reasonable efforts to provide accurate product descriptions, specifications, images, pricing and compatibility information.
Product images may be provided by manufacturers or distributors and may differ slightly from the actual product, including packaging, colour or appearance.
Manufacturer specifications and product information may change without notice.
If there is a material error in a product listing or information supplied with an order, applicable consumer rights remain unaffected.
3. MOTORCYCLE FITMENT & COMPATIBILITY
Our Year, Make and Model selection tools and other fitment information are provided to help customers identify potentially compatible products.
Fitment information may originate from manufacturers, distributors or other product-data sources.
Customers should review the product description, specifications, part numbers and compatibility information before installation.
Certain motorcycles may have differences based on trim, submodel, production date, modifications or previously installed aftermarket components.
If you are uncertain whether a product is suitable for your motorcycle, please contact TRX MOTO before purchasing or installing the product.
Nothing in this section limits rights available under applicable consumer protection law where a product does not conform to its description or representations made by TRX MOTO.
4. PRICES
Unless otherwise indicated, prices displayed on our website are in Canadian dollars (CAD) and do not include applicable taxes.
Applicable taxes and shipping charges will be calculated or displayed during checkout where required.
Prices may change without notice before an order is placed.
If an obvious pricing, description or technical error is discovered in connection with an order, TRX MOTO will contact the customer and handle the matter in accordance with applicable law.
5. ORDERS
Submitting an order through our website does not prevent TRX MOTO from verifying product availability, payment information, suspected fraud, shipping information or other information reasonably necessary to process the transaction.
Customers are responsible for providing accurate contact, billing and delivery information.
If we cannot fulfill an order, we will notify the customer and issue any refund required.
Nothing in these Terms limits cancellation or other rights provided to consumers by applicable law.
6. PRODUCT AVAILABILITY
Products displayed on our website may be stocked by TRX MOTO or supplied through manufacturers and distributors.
Inventory information may change and, despite reasonable efforts to maintain accurate availability information, an item may occasionally become unavailable after an order is submitted.
If an ordered item becomes unavailable, TRX MOTO will contact the customer regarding available options and provide any refund required.
7. PAYMENT
Payment must be made using one of the payment methods available during checkout.
Payments may be processed by third-party payment providers such as Stripe or PayPal.
TRX MOTO does not intend to directly store complete payment-card numbers through its website.
Orders may be subject to reasonable payment and fraud verification.
8. SHIPPING & PICKUP
Available shipping and pickup options are displayed during checkout.
Shipping rates and delivery availability may depend on the destination, product weight, dimensions and other shipment characteristics.
Customers selecting local pickup should wait until TRX MOTO confirms that the order is ready before arriving for collection.

9. RETURNS & REFUNDS
Returns, exchanges and refunds are subject to the conditions described in our Shipping & Returns policy and applicable law.
Our store return policy does not limit any rights or remedies that a customer may have under applicable consumer protection legislation.
10. INSTALLATION OF MOTORCYCLE PARTS
Motorcycle parts and accessories should be installed correctly and in accordance with applicable manufacturer instructions.
Certain components may require specialized knowledge, tools, measurements, adjustments or professional installation.
Incorrect installation, modification or use may affect product performance and motorcycle safety.
Customers who are uncertain about installation should consult TRX MOTO or another qualified motorcycle technician.
Nothing in this section excludes responsibility or consumer rights that cannot legally be excluded.
11. WARRANTIES
Products sold by TRX MOTO may be covered by manufacturer warranties where applicable.
Products sold to consumers may also benefit from legal warranties and other rights provided by applicable law, including the legal warranties applicable in Quebec.
Nothing in these Terms & Conditions excludes, restricts or replaces a legal warranty or other consumer right that cannot lawfully be waived.
12. WEBSITE ACCOUNTS
Customers are responsible for maintaining the confidentiality of their account credentials and for providing accurate account information.
Please contact TRX MOTO if you believe your account has been accessed without authorization.
13. INTELLECTUAL PROPERTY
Unless otherwise indicated, TRX MOTO branding, logos, original website content, graphics and other materials created by TRX MOTO are owned by or licensed to TRX MOTO INC.
Third-party trademarks, product names, logos and images remain the property of their respective owners.
TRX MOTO website content may not be reproduced or commercially used without permission except where permitted by law.
14. THIRD-PARTY SERVICES
Our website may interact with third-party services such as payment processors, shipping providers and other technology providers.
Use of those services may also be subject to the applicable provider's terms and privacy practices.
15. LIMITATION OF LIABILITY
To the extent permitted by applicable law, TRX MOTO is not responsible for losses resulting solely from circumstances outside its reasonable control or from misuse, unauthorized modification or improper installation of products.
This provision does not exclude or limit any liability, warranty, remedy or consumer right that cannot legally be excluded or limited.

17. APPLICABLE LAW
These Terms & Conditions are governed by the laws applicable in Quebec and Canada.
For consumer transactions, nothing in these Terms restricts rights relating to jurisdiction, remedies or applicable law that are granted to consumers by mandatory legislation.
18. CHANGES TO THESE TERMS
TRX MOTO may update these Terms & Conditions from time to time.
The current version will be published on our website with the date of the latest update.
Changes will not retroactively remove rights that have already arisen under an existing transaction.
